KPK Talks About the Possibility of Forcing Papuan Governor Lukas Enembe



The Corruption Eradication Commission (KPK) has spoken about the possibility of forcibly picking up Papuan Governor Lukas Enembe. However, until now the KPK is still examining the results of Luke's health examination by the KPK team of doctors and the Indonesian Doctors Association (IDI).

"If there is a need for a forced pick-up of a suspect, yes, we will definitely do it," said KPK Head of News Ali Fikri in his statement, Tuesday (8/11).
 
Ali said that his party was still investigating the results of Lukas Enembe's examination at his residence in Papua. It is known, the KPK team together with KPK Chair Firli Bahuri had a chance to meet Lukas Enembe on Thursday, November 3, 2022.
 
"Of course we have to do an in-depth analysis that once again we don't want to violate the law when enforcing the law. And what needs to be underlined is that in upholding the law, upholding human rights is important," said Ali.
 
According to Ali, forcibly picking up a suspect can be done when the suspect is absent from the examination without any information. But for Lukas Enembe, according to Ali, his legal representative is still trying to communicate with the KPK investigators team.

"That forced pick-up is a normative provision in criminal procedural law, there is room for that, in article 112 of the Criminal Procedure Code or KUHAP it exists. When for example a suspect is absent, there is no confirmation at all on the first summons, the second , only the three of them were taken or forcibly picked up, it can be done," said Ali.

"Well, in this process, there is indeed a room for discussion, even though we always remind our legal advisers not to open it in the public sphere," Ali added.
 
New Evidence Finding

The Corruption Eradication Commission (KPK) has found new evidence of the alleged bribery and gratification of infrastructure projects in Papua that ensnared Papuan Governor Lukas Enembe.
 
The new evidence was found after a team of investigators from the anti-corruption agency searched three locations in Jayapura, Papua. The three locations are the residence of the parties involved in the case and two private company offices.

"Friday (4/11), the KPK investigation team has also finished searching 3 locations in Jayapura City, namely the residence of the party related to the case and two private company offices," said KPK News Head Ali Fikri in his statement, Saturday (5/11).

Ali said that from the three locations the KPK investigators found new evidence of the alleged bribery and gratification of Lukas Enembe. The evidence will be the completeness of the case file by first being analyzed and confiscated by the investigator team.

"From that location, various documents and electronic evidence were found and secured which are suspected to be related to proving this case," said Ali.
 
KPK Leader Meets Luke Enembe

Previously, on Thursday, November 3, 2022, KPK Chairman Firli Bahuri came to Papua to meet Lukas Enembe at his residence. Together with Firli, the KPK investigators and doctors and a team of doctors from the Indonesian Doctors Association (IDI) also participated.

They checked the health of Luke Enembe, who had been absent from time to time citing illness. The investigative team also asked Lukas Enemebe for information. The inspection took less than two hours.

Firli's act of meeting Luke has drawn criticism. IM57+ Institute which consists of former KPK employees who were removed through the national insight test (TWK) considers Firli's attitude to be a breath of fresh air for corruptors.

According to the Chairman of IM57+ Institute Praswad Nugraha, it is not impossible that other corruptors will try to approach Firli in various ways.
 
"This treatment sets a bad precedent for handling cases in the future, because the suspect will try to use the same approach so that he can become a bargain with the KPK leadership," said Praswad in his statement, Saturday (5/11).

Praswad considered that Firli should not act in this way with Lukas Enembe, who is often absent from summons for questioning as a suspect. According to Praswad, Firli's attitude has hurt the community's sense of justice.

"For the public, seeing the drama of Firli's intimacy with Lukas, it is like there is special and preferential treatment by state officials against corruption suspects. The sense of justice in the community will be hurt," said Praswad.

Praswad questioned behind the preferential treatment that Firli showed to Lukas. Moreover, according to Praswad, not everyone can feel the warmth of Firli's attitude which is instead aimed at corruption suspects.
 
"Even us Bansos corruption investigators never received that warmth from Firli. We were instead terrorized and given a code of ethics sanction while carrying out the task of dismantling the Bansos corruption case," said Praswad.
