The Corruption Eradication Commission (KPK) detained the Head of the People's Welfare Section (Kabag Kesra) of the Mimika Regional Secretariat Marthen Sawy (MS) as the acting commitment maker as a suspect in the alleged corruption case related to the construction of the Kingmi Mile 32 Church, Mimika, Papua.
"For the purposes of the investigation, the investigative team detained the suspect MS for the first 20 days, starting from September 20, 2022 to October 9, 2022 at the East Jakarta Police Detention Center," said KPK Deputy for Enforcement and Execution Karyoto during a press conference at the KPK Red and White Building, Jakarta, Tuesday.
MS is suspected of violating Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
Previously, the KPK had detained another suspect in this case, namely Mimika Regent Eltinus Omaleng (EO). Apart from Eltinus and MS, there are also other suspects who have not been arrested, namely the Director of PT Waringin Megah (WM) Teguh Anggara (TA).
In the construction of the case, Karyoto explained that around 2013, Eltinus, who works as a contractor and Commissioner of PT Nemang Kawi Jaya (NKJ) wanted to build a place of worship in the form of the Kingmi Mile 32 Church in Mimika Regency with a value of Rp126 billion.
After that, in 2014, Eltinus was elected as the Regent of Mimika Regency for the 2014-2019 period and he then issued one of the government's policies, namely to budget a grant for the construction of the Kingmi Mile 32 Church to the Waartsing Foundation.
Then, the Mimika Regency local government budget team (TAPD), as ordered by Eltinus, included a grant and construction budget for the Kingmi Mile 32 Church of IDR 65 billion into the Mimika Regency Government budget in 2014.
Eltinus, who was still a Commissioner of PT NKJ at that time, built and prepared a concrete production equipment located right in front of the construction site of the Kingmi Mile 32 Church. This continued in 2015.
To accelerate the construction of the church, Eltinus offered this project to Teguh Anggara (TA) as the director of PT WM with an agreement to share a fee of 10 percent of the project value where Eltinus received 7 percent and Teguh 3 percent.
In addition, so that the auction process can be conditioned, Eltinus deliberately appointed the suspect MS as the official making the commitment. In fact, MS does not have competence in the field of building construction. With the appointment, MS allegedly asked for "fees" from a number of parties involved in this project.
Next, Eltinus ordered MS to win TA as the winner of the project even though the auction activity had not been announced.
After the auction process was conditioned, MS and TA signed the contract for the construction of the Kingmi Mile 32 Church with a contract value of Rp46 billion.
For the execution of the work, TA subcontracted the entire construction work of the Kingmi Mile 32 Church to several companies. One of them is PT Kuala Persada Papua Nusantara (KPPN) without a contract agreement with the Mimika Regency Government, but Eltinus knows.
PT KPPN subsequently used and leased PT NKJ's equipment with Eltinus who still serves as commissioner of PT NKJ.
In the implementation of this project, it turns out that the development of the Kingmil Mile 32 Church is not in accordance with the completion period as stated in the contract, including the lack of work volume, even though the payment for the work has been carried out.
As a result of the actions of the suspects, there was a state financial loss of around Rp. 21.6 billion from the contract value of Rp. 46 billion. From the project, Eltinus is suspected of having received an amount of around Rp. 4.4 billion.
