Indonesia Corruption Watch (ICW) urged the Corruption Eradication Commission (KPK) to immediately pick up the Governor of Papua Lukas Enembe.
ICW researcher Kurnia Ramadhana assessed that the legal process against Lukas Enembe had been protracted.
Not only forcibly picked up, according to him, if necessary the KPK arrested Lukas Enembe for later detention.
"ICW encourages the KPK to immediately take legal action in the form of forcibly picking up the Governor of Papua. In fact, if needed, it is not only forced pick-ups, but arrests," Kurnia said in a written message to reporters, Wednesday (28/9/2022).
Kurnia said the next action after the forced pick-up was to check Luke with the Indonesian Doctors Association (IDI). This action is needed so that the KPK has a second opinion regarding the health condition in question.
If the results of the examination state that Lukas Enembe is sick, the KPK can determine the ban.
On the other hand, if the second opinion states that Luke is healthy, then the parties who make lies regarding Luke's condition must be punished.
"KPK must ensnare parties who manipulate Luke's health condition with Article 21 of the Corruption Law regarding obstruction of justice," said Kurnia.
Previously, Lukas Enembe was named a suspect in the alleged bribery and gratification case related to the Papua Provincial Government Budget.
However, for the second time, Lukas Enembe did not fulfill the summons of the two KPK investigators on Monday (26/9/2022). His lawyer argued that his client was sick.
They then returned to the KPK to explain Luke's condition and discuss the possibility that the KPK doctor would examine Lukas in Jayapura.
In addition, they also asked the KPK to allow Lukas to get permission for treatment abroad.
Related to this, the Deputy Chairman of the Corruption Eradication Commission, Alexander Marwata, admitted that he had ordered the investigation team to coordinate with IDI to get a second opinion.
"There must be a second opinion. We have ordered that we coordinate with IDI to examine Mr. Lukas, maybe in Jayapura," said Alexander Marwata when met by the media crew at the KPK's Red and White Building, Monday (26/9/2022).
Meanwhile, regarding the possibility of a KPK doctor conducting an examination of Lukas Enembe in Jayapura, the Head of the KPK News Section, Ali Fikri, has a different view.
He emphasized that in this case the KPK summoned Lukas Enembe to be questioned in Jakarta, instead of being asked to go to Jayapura.
"This is what we called the suspect, not us who were summoned and ordered to go there," he said.
Luke Enembe's Health Problem, KSP: KPK Already Has Mechanisms
Deputy V of the Presidential Chief of Staff (KSP) Jaleswari Pramodhawardani said, if the legal process for Lukas Enembe is still hampered by health reasons, the Corruption Eradication Commission (KPK) already has its own mechanism.
He also reminded that the health factor of the Governor of Papua should not be used as an excuse to hinder law enforcement.
"Technical matters related to medical interests, the KPK already has its own mechanism which in its implementation does not reduce the rights of suspects," Jaleswari said in a written statement on Tuesday (27/9/2022).
Jaleswari said it is ironic when there are officials who should set an example of respecting the legal process but do not do so.
This was conveyed by Jaleswari in response to the statement of the attorney for the alleged gratification case of Lukas Enembe, Stefanus Roy Rening.
"It is ironic when officials who are supposed to set an example and have a high commitment in respecting the legal process that they are currently facing do not show the example and commitment to the maximum," said Jaleswari.
He also alluded to President Joko Widodo's statement on Monday (26/9/2022) asking Lukas Enembe to respect the legal process at the KPK.
According to him, the president's statement is a deep reflection on the dynamics of the law enforcement process at the KPK.
"When examined more deeply, it is actually a deep reflection of the dynamics currently developing regarding the law enforcement process that is being pursued by the KPK," he said.
Meanwhile, the attorney for the Governor of Papua Lukas Enembe, Stefanus Roy Rening admitted to respecting President Joko Widodo's order to ask his client to respect the KPK's summons.
However, said Stephen, Luke is currently sick. He said he was trying to find a solution to this problem.
"We also want to convey to Mr. President Jokowi, Mr. (Lukas) is sick and how we find a solution so that the disease is cured first and then we enter the investigation stage," Stefanus said at a press conference at the Papua Provincial Government Representative Office, South Jakarta, Monday.
